Terms & Conditions

  1. For the purpose of this promotion the following definitions apply:

App” means the Broncos FanTribe Loyalty App available on the App Store and Google Play Store.

Promoter” means the Brisbane Broncos Limited (ABN: 41 009 570 030) of Fulcher Road, Red Hill  Brisbane  QLD  4059.

Promotion” means the Broncos FanTribe Loyalty Promotion conducted via the app during the course of the Promotional Period.

Game Week” means a singular seven-day week from 12:01am (AEST) Monday to 11:59pm (AEST) Sunday.

Promotional Period” means the period commencing 9am (AEST) Wednesday 1 February 2017 and closing 5pm (AEST) Friday 8 December 2017.

Season Points” means the number of points accumulated over the full Promotional Period from 9am (AEST) Wednesday 1 February 2017 to 5pm (AEST) Friday 8 December 2017.

Weekly Points” means the number of points accumulated over each Game Week from 12:01am (AEST) Monday to 11:59pm (AEST) Sunday. The Weekly Leaderboard resets at the start of each new Game Week.

Website” means: http://www.fantribe.co/brisbane-broncos

Tokens are the electronic currency used to buy items on FanTribe like Flash Sales, Premium Videos and club or sponsor experiences. Tokens are purchased via the Fan Card side menu using a credit or debit card. Tokens expire on 31 December of the following year after being purchased, meaning they have a maximum two year shelf life.

Points are values automatically awarded to FanTribe users based on their App activities. Points are not deducted when you claim any benefits. However, all points earned throughout the season are automatically reset back to zero at the end of each calendar year on 31 December, giving them a maximum one year shelf life.

  1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation is deemed as acceptance of these Terms and Conditions and the App’s Terms of Use. In the event of any inconsistency, these Terms and Conditions shall prevail. The laws of Australia apply to this Promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.

Eligibility

  1. To participate in the competition to win Weekly or Season Prizes, and access any other features of the App, the entrant must be a registered user of the App. When registering to become a user, the entrant must provide Personal Information (as this term is defined in the Privacy Act 1988 {Cth}) including first (given) name and last (family) surname, a valid email address and current mobile phone number.

 

  1. The entrant agrees to provide accurate and complete information and to keep this information updated. The information is stored securely, and will only be used and disclosed in accordance with our Privacy Policy which can be accessed here: http://www.fantribe.co/brisbane-broncos/privacy-policy
  2. Entry is open to Australian residents aged 13 years and over, except where prohibited (“Eligible Entrants”). Only Australian residents are eligible to win any prizes, excluding the directors, managers and employees (and their immediate family) of the Promoter and agencies associated with this Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

Registration

  1. To enter, users must first register their account via the App. Entrants will be required to: (a) register using their Facebook account, (b) verify their mobile phone number, and (c) provide their email address if they haven’t done so through their Facebook account. A valid email address and mobile phone number must be provided during FanTribe registration.
  2. Only one eligible registration per entrant (and per Facebook account) will be accepted.
  3. All registered App users will receive Points in accordance with Clause 11 below. Eligible entrants will be ranked on the Season and Weekly Leaderboards by their Season Points earned to date for the calendar year, and by their Weekly Points earned respectively for each Game Week.
  4. The Promoter may in its absolute discretion disqualify any entrant who submits multiple entries, or tampers with, or benefits from tampering with, the entry process or fair conduct of the competition.
  5. During registration, entrants may refer the Promotion to their friends via the Facebook Invite Friends functionality. If an entrant refers a friend, they warrant that they obtained their friend’s consent to do so. The entrant indemnifies the Promoter against any claims by third parties for the entrant’s failure to do so.
  6. Entrants will score points based upon the various actions they perform while using the App during the Promotional Period as specified below. Points are likely to change as more features are added to the App.

  1. The Promoter’s decisions on all aspects of this Promotion are final and no correspondence will be entered into, including decisions regarding the number of points that the entrant may have earned.
  2. Entrants’ positions for each Game Week will appear on the App’s Weekly Leaderboard. The Weekly Leaderboard will reset at the start of each new Game Week which runs from 12:01am (AEST) Monday to 11:59pm (AEST) Sunday.
  3. Entrants’ positions for the Season will appear on the App’s Season Leaderboard commencing 9am (AEST) Wednesday 1 February 2017 and closing 5pm (AEST) Friday 8 December 2017.
  4. App leaderboard positions may not give a true indication of the eventual prize winners, as they rank all users, not just eligible entrants.

Weekly Prize

  1. There will be 27 Weekly Prizes, one (1) for each Game Week, starting from Round 01 of the NRL Premiership Season through to the final Round 26 of regular competition – including Representative Round.
  2. Each Weekly Prize winner selection will occur at 12:01pm (AEST) Monday on the dates detailed below at the Brisbane Broncos HQ, Red Hill.
  3. The Weekly Prize will be awarded to the Eligible Entrant who earns the most points for that particular Game Week, excluding any entrant who is ineligible to win the prize in accordance with clauses 3-7.
  4. Eligible Entrants can win the Weekly Prize multiple times but only once in a calendar month as determined by which month the winner publication date falls into in clause 22. If there are two or more Eligible Entrants with equal highest points earned for the same Game Week, the Weekly Prize will be awarded to the person who reached this points level first.
  5. The Weekly Prize winner will be notified by email within two (2) days of being determined, and their registered ‘handle name’ will be published on or before the dates in clause 22.
  6. If a Weekly Prize remains unclaimed by 12:01pm (AEST) Tuesday 31 October 2017, the original winner selected will forfeit their Weekly Prize. All reasonable efforts will be made to contact each winner.
  7. The Weekly Prize is a $170 Broncos Superstore Online Gift Voucher. These gift vouchers can only be redeemed online and are valid for 12 months from their date of issue. The total Weekly Prize value available is: $4,590.00 AUD.

Season Prize

  1. The selection process for the winner of the major Season Prize will occur at 12:01pm (AEST) Monday 11 December 2017 at Brisbane Broncos HQ, Red Hill.
  2. The Eligible Entrant with the most Season Points earned by the conclusion of the Promotional Period at 5pm (AEST) Friday 8 December 2017 will win the Season Prize. The winner will be notified by email and phone and their details will be published on Tuesday 12 December 2017.
  3. If the Season Prize remains unclaimed by 12:01pm (AEST) Thursday 21 December 2017, the original winner selected will forfeit their Season Prize. All reasonable efforts will be made to contact the winner.
  4. If there are two or more Eligible Entrants with equal highest points earned for the season’s Promotional Period, the Season Prize will be awarded to the person who reached this points level first.
  5. The Season Prize is a 14 day Alaska & The Rockies Trip for 2.
    1. Total prize is valued at $13,998 (AUD).

    2. Promotion closes 5:00pm (AEST) Friday 8 December 2017.

    3. The winner will be announced at 1pm (AEST) Monday 11 December 2017.

    4. Only one (1) prize will be awarded to the eligible entrant for this prize.

    5. In the event of tied highest season points earners, the eligible entrant who reached the points value first, will be deemed the winner.

    6. The prize cannot be redeemed for cash or exchanged for goods and services.

    7. The Promoter is the Brisbane Broncos Limited (ABN: 41 009 570 030) of Level 1, 92 Fulcher Road, Red Hill, Brisbane QLD 4059.

    8. Entry is open to registered Broncos FanTribe users aged 18 years and over and is open to Australian residents only.

    9. The Promoter may, in their complete discretion, refuse to award, amend or cancel the prize usage by any person at any time for any reason. Any changes to the competition or prize will be notified to the entrants as soon as possible by the Promoter.

    10. The Promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.

    11. Prizes are subject to availability and the Promoter reserves the right to substitute any prize with another of equivalent value without giving notice.

    12. The Promoter’s decisions in respect of the competition are final and no correspondence will be entered into.

    13. The winner agrees to the use of his/her name and image in any publicity material.

    14. If the winner cannot be contacted or does not claim the prize within 14 days of notification, the Promoter reserves the right to withdraw the prize and pick a replacement winner.

    15. Entering the competition means you accept these terms and conditions.

Weekly & Season Prizes General

  1. The Promoter reserves the right, at any time, to verify the validity of entries and entrants – including an entrant’s identity, age and place of residence, and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  2. If any prize becomes unavailable, the Promoter in its absolute discretion, reserves the right to substitute the prize with another of equal value and/or specifications.
  3. Prizes are not exchangeable and cannot be taken as cash.
  4. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photos, film and/or recordings) in any media for an unlimited time without remuneration for the purpose of promoting this competition and any services supplied by the Promoter.
  5. Any costs associated with accessing these promotions and the App is the entrant’s full responsibility and is dependent on the internet and mobile service provider used.
  6. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) the prize.
  7. The Promoter collects Personal Information to conduct this Promotion. It may, as detailed in the Promoter’s Privacy Policy at: www.fantribe.co/brisbane-broncos/privacy-policy  disclose such information to third parties, including but not limited to, prize suppliers. Entry is conditional on providing this information.
  8. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter by emailing info@broncos.com.au. All entries become the property of the Promoter.

Broncos FanTribe – App Features – Terms & Conditions

For the purpose of these General Terms Of Use, ‘we’, ‘us’, ‘our’ refers to FanTribe / Brisbane Broncos and ‘you’, ‘your’, ‘user’ refers to the registered user of the Broncos FanTribe App.

App Goods & Services

Where the App’s goods and services are supplied to us by third parties (“Merchants”), we will do our best to verify the information provided to us by the merchants, but we cannot guarantee its accuracy. You understand and agree that we cannot be held responsible for errors or omissions caused by incorrect or inadequate information supplied to us or by merchants. You agree to make your own enquiries to verify information provided and to assess the suitability of products before you purchase them.

App Tokens

  • Features like Flash Sales and Premium Videos require users to purchase Tokens to participate.
  • The number of Tokens a user owns is shown in the side Fan Card menu by swiping right on the screen or by tapping on the Menu icon in the top left-hand corner.
  • Users aged under 18 years must get consent from a parent/guardian prior to purchasing Tokens via the Fan Card side menu.
  • Token Bundle amounts and prices are shown in the table below:

Tokens can be purchased with a credit or debit card. Once the transaction is complete, the number of Tokens – including Bonus Tokens, will be credited to the user’s account and displayed in the App.

  • This payment gateway is managed by a third party “Stripe Inc.”. Stripe’s terms and conditions and privacy policy can be found here: https://stripe.com/au/privacy
  • Once Tokens are purchased, they cannot be refunded or exchanged for cash.
  • Where Tokens are required for App activities and purchases, a ‘Token Icon’ with the quantity of Tokens required is displayed. The user must have sufficient Tokens to purchase the displayed item.
  • Tokens are charged in Australian Dollars (AUD) and include GST.
  • Tokens expire on 31 December of the following year after being purchased, meaning they have a maximum two year shelf life.

Flash Sales

To access Flash Sales, users must register with the App in accordance with clauses 3-7. Any participant under the age of 18 must get consent from a parent/guardian prior to making any purchases.

Buying A Flash Sales Item

  • Flash Sale items can only be purchased using App Tokens (See App Tokens).
  • The number of Tokens required to purchase each item are listed with the product or service.
  • Users must have sufficient Tokens in their account to purchase a Flash Sales item.
  • Users can buy more Tokens by following the purchasing Tokens process.
  • All Tokens must be received in full prior to a voucher or purchase confirmation being issued.
  • Terms & Conditions for Flash Sales items appear on the App and via these Terms & Conditions.
  • Once purchased, the Flash Sales item will be available to you in the App’s Redeem section located on the side Fan Card menu and an email voucher will be sent to your nominated email address.
  • Follow the How To Redeem instructions on your voucher to redeem your Flash Sales item.

Faulty Products

To the extent allowed by law, our liability for breach of any warranty will at our option be limited to:

– in the case of goods:

  • the replacement of the goods or the supply of equivalent goods;
  • the repair of the goods;
  • the payment of the cost of replacing the goods or of acquiring equivalent goods; or
  • the payment of the cost of having the goods repaired; and

– in the case of services:

  • the re-supply of the services; or
  • a refund of the purchase price paid.

Purchases

Purchases placed by you are offers to purchase a particular App product or service under the Terms & Conditions in this agreement, together with any merchant-specific Terms & Conditions. We reserve the right to accept or reject your order for any reason at any time, including but not limited to:

  • because of the unavailability of any product or service;
  • because of an error in the price or product or service description; or
  • because of an error in your order.

If we cancel your order, we will provide a full refund of any payment received. You agree that we are not liable for any loss suffered as a result of you being unable to access your redemption voucher. Once any purchase is made, Tokens will be deducted from your account and you cannot cancel your order.

Price

Price is the number of Tokens required to purchase each Flash Sales item. Prices of any products or services are current at the time of display, but are subject to change without notice.

Voucher Redemption / Product Supply

Any App voucher you receive is redeemable for the purchased product or service, from the relevant merchant, who is solely responsible for honouring this voucher. While we try (as much as possible) to only promote merchants whom we feel provide good products and services, we can make no guarantees, warranty or representation regarding the standard of any third party product or service supplied.

Vouchers cannot be exchanged or redeemed for cash. Unless specifically stated otherwise, vouchers cannot be combined with any other gift certificates, vouchers or promotions.

We are not responsible for lost or stolen vouchers or fraudulent use of voucher unique reference numbers.

For vouchers relating to products provided by merchants, you may be required to collect the relevant product from a specified location, or to pay a fee to have the product delivered to your specified address.

Voucher Expiry / Extension

Vouchers expire on the date indicated on the voucher itself (if applicable). Expired vouchers are non-refundable in whole or part. Expired vouchers are invalid and will not be honoured by the merchant.

Where bookings are required, some merchants may experience a large volume of bookings towards the conclusion of the validity period. It is strongly recommended that all bookings are made well before the conclusion of the validity period. No refunds will be issued in the event that you are unable to have the service performed due to the unavailability of bookings.

Refunds

We will only refund vouchers in accordance with its own Refunds Policy (if applicable). Should a refund be agreed, this will be provided as Tokens.

Complaints

We have no liability (including loss or damage) for any act, omission or default, whether negligent or otherwise, of any third party merchant. If you wish to complain about a merchant, you must provide us with written feedback via the Leave feedback section located on the side Fan Card menu. Refunds will only be provided in accordance with our Refunds Policy.

Merchant Terms & Conditions

Any specific merchant’s Terms & Conditions will always apply in addition to any specific FanTribe Terms & Conditions. For example, if a merchant is not open on certain days, the voucher will not be redeemable on those days. Refunds are not payable in the event that you are unable to use a voucher on account of the merchant’s usual Terms & Conditions.

Rewards

All users who register for the App in accordance with clauses 3-7 will be eligible to redeem Rewards when they become available. Any participant under the age of 18 must get consent from a parent/guardian prior to claiming any App Rewards.

A Reward is defined as a ‘gift’ to users for their loyalty to the App. This can be anything from free movie passes, to discounted match tickets, to a money-can’t-buy experience such as a coin toss at a home game.

Claiming A Reward

To claim a Reward, users must collect points by performing various actions within the App as outlined in clause 11. Each Reward item will specify the following information:

  • Amount of points required to unlock the Reward.
  • How many points you have accumulated and how many points you still need.
  • When the Reward will expire (if applicable).
  • How many Reward items are available (if applicable).

A user’s points will only start accumulating against a new reward once a reward becomes active.

Existing points can be used for other incentives like pre-existing rewards, winning prizes and increasing FanTribe user rankings. Points are not deducted when users claim any rewards or benefits on FanTribe.

Please Note: All points earned throughout the season are automatically reset back to zero at the end of each calendar year on 31 December, giving them a maximum one year shelf life.

  • Terms & Conditions for Rewards items appear on the App and via these Terms & Conditions.
  • Once claimed, the Rewards item will be available to you in the App’s Redeem section located on the side Fan Card menu and an email voucher will be sent to your nominated email address.
  • Follow the How To Redeem instructions on your voucher to redeem your Rewards item.

Play & Win

App users will have three (3) spins per day with Play&Win. After three (3) spins, the user will have to wait until 12:01am the next day to play again.

Winners will be randomly determined via an algorithm built into the App which awards prizes based on spin flow and the number of users playing the Play&Win game at any given time.

The prize/s for Play&Win will normally be points that are added to the winning user’s points total. These points will go towards the user’s leaderboard ranking and rewards accumulation.

The prize/s for Play&Win can also be an Instant Win physical or digital good supplied by a commercial partner or advertiser. Any Advertiser specific terms and conditions of this Prize will be included in the Voucher sent by email. Prizes are not redeemable for cash.

Match Predictions

Predictions for upcoming games will open when team line-ups become publicly available for each NRL Round. Prediction questions will remain open until the start of the match. Prediction answers cannot be submitted or changed by any user once the match kicks off.

Prediction results are awarded based on the match data statistics provided to us by a third party vendor. At the given time the prediction results are awarded, the result is deemed correct. Any changes to the match statistics after the results have been announced, will not change the results of the prediction.

Premium Videos

Buying A Premium Video

  • Premium Videos can be purchased using App Tokens (See App Tokens).
  • The number of Tokens required to purchase a Premium Video is listed on its details page.
  • Users must have sufficient Tokens in their account to purchase a Premium Video.
  • Users can buy more Tokens by following the purchasing Tokens process.
  • Once purchased, the Premium Video will be available to view in the App’s Video section located on the side Fan Card menu.

Video Viewing

App users must have a compatible handset that will play videos in MP4 format, as well as internet connectivity, whether via Wi-Fi or their mobile network provider.

The Broncos do not accept any liability for the incompatibility of their videos with any mobile device. Videos may not work correctly if the manufacturer’s installed video player is removed or replaced.

Purchased Premium Videos can only be played within the App and cannot be shared with other users, accounts or devices. No refunds will be provided once a Premium Video has been purchased.

Some videos will have an expiry date. An expired video will no longer be available in the user’s account unless it has been purchased.

Broncos FanTribe – App General – Terms & Conditions

App Usage

You agree not to access (or attempt to access) any part of the App by any means other than through the interface provided.

You agree that you will not engage in any activity that interferes with or disrupts the App or the servers and networks hosting the App. You may not use data mining, robots, screen scraping or similar data gathering and extraction tools on the App except with our prior written consent.

You agree not to, or attempt to, circumvent, disable or otherwise interfere with security-related features of the App or features that prevent or restrict use or copying of any content or enforce limitations on the use of the App or the content therein.

You agree not to use, copy, distribute or commercialise content except as permitted by this agreement, by law, or with our prior written consent. You understand and agree that any suspected fraudulent, abusive or illegal activity may be referred to appropriate law enforcement authorities.

We reserve the right to cancel your registration at any time, subject to our complete discretion. If you have previously purchased a sale item or items, we will email you a copy of any vouchers prior to cancelling registration. In the event of cancellation of registration, our decision is final and binding.

To the extent allowed by law, we exclude all liability to you or anyone else for loss or damage of any kind (however caused or arising) relating in any way to the content of the App including, but not limited to:

  • mistakes or inaccuracies in the App;
  • you acting, or failing to act, on info contained in or referred to in the App and/or linked website;
  • any interruption or cessation of transmission to or from the App;
  • any bugs, viruses, Trojans or other malevolent code or communications which may be transmitted to or through our App by any third party; and/or
  • the merchantability or fitness for any purpose of any goods or service of any linked sites.

Mobile Usage

FanTribe requires the user to download the iOS or Android version App using their mobile network or internet service. Users must have the bill payer’s consent to use their mobile internet. Some service providers and mobile devices may not provide access to mobile internet, so users must check if unsure.

Downloading and accessing the App’s mobile content, including web-based links, may incur data charges. Users will need to refer to their contracts with their mobile carrier or Internet Service Provider for costs. Users accessing the App overseas will also incur data roaming charges. All queries relating to carrier rates or mobile or internet bills, should be directed to your mobile carrier or Internet Service Provider.

FanTribe Liability

All content such as comments, messages, text, files, images, photos, video, sounds and other materials posted on, transmitted through or linked from the App, are the sole responsibility of their source.

You understand that FanTribe does not control and is not responsible for content made available through the App unless it originates from us. So by using this App, you may – contrary to this agreement and our intentions – be exposed to content that you find offensive, indecent, inaccurate, misleading or otherwise objectionable. You use the App at your own risk.

Third Party Website Links

The App may include links to other websites, content or resources. These links may be operated by third parties and we may have no responsibility or control over them. These links do not imply that we endorse the website, content or resource. Governing Law

These Terms & Conditions will be governed by and interpreted in accordance with the laws of Australia. You irrevocably submit to the exclusive jurisdiction of Australian courts.

Change Of Control

Subject to relevant laws, if we merge, sell or otherwise change control of our business or this App, we reserve the right, without giving notice or seeking consent, to transfer or assign your Personal Information, content and rights that we have collected from you and any agreements we have made with you.

Indemnity

You will at all times indemnify us and our directors, officers, employees and agents against any loss (including reasonable legal costs and expenses on a full indemnity basis) or liability suffered by you or by us arising from any claim, demand, suit, action or proceeding by any person against you or us, where such loss or liability arose out of, in connection with or in respect of, your conduct or breach of this agreement.

Communications

As a condition of registering with FanTribe, you consent to us sending you administrative emails, which detail your account activity and App purchases. We will also from time to time send marketing and promotional materials from us and our commercial partners. We will always try to ensure this communication is of relevance to you and your interests.

Intellectual Property

We reserve all intellectual property rights, including but not limited to, copyright of the “content” and/or services provided by us. Nothing in this agreement gives you any right to use any of our content, marketing material, business names, trademarks, logos, domain names or other distinctive brand features. Other trademarks used in the App that belong to third parties, are used with their consent and remain the intellectual property of that party.

If you correspond or otherwise communicate with us, you automatically grant us an irrevocable, perpetual, non-exclusive, royalty-free, worldwide license to use, copy, display and distribute the content of your correspondence or communication, and to prepare derivative works of the content or incorporate the content into other works to publish and promote such content. This may include, but is not limited to, publishing testimonials on the website and developing your ideas and suggestions for App improvements.

Deleting Your Account

If you decide to delete your FanTribe account, you acknowledge that you will forfeit all remaining tokens and items that have yet to be redeemed, that you have in your account.

Personal Information Collection

We will only request or collect your Personal Information for the purpose of better providing or tailoring our App features, products, services, prizes, polls, Flash Sales, Rewards, Videos and Newsfeed to your demographic. We will seek your direct consent when requesting Personal Information above what you have provided when linking your Facebook account to FanTribe during the App registration process. We may share your Personal Information with third parties in order to provide Rewards and Flash Sales services and remarketing.
